Can my employer stop me from getting workers’ compensation benefits?

The short answer is yes, your employer can prevent you from getting workers’ compensation benefits.

When you file a workers’ compensation claim, your claim will be filed under the Nebraska Workers’ Compensation Act and your benefits should be paid  for by your employer or employer’s  workers compensation insurance company.

However insurance companies deny claims for a variety of reasons such as lack of medical evidence or failure to timely report.  Other times an employer may refuse to allow an injured employee to file a claim. Even more troubling is if the insurance company “accepts” the claim but does not provided all benefits available or misrepresents what benefits are available.
