What are the risks of filing a workers’ compensation claim?

When you are injured at work, you have a right under the Nebraska Workers’ Compensation Act to receive medical and indemnity benefits while you are unable to return to work. If you are being truthful about the cause of your injury and its impact on your life, then the only risk you will face in filing a claim is that the insurance company or your employer will try to push you around and deny your claim.

In our opinion, we think that this risk is minimal when compared to the potential rewards: being able to have the time to heal from your injuries while still supporting your family. Furthermore Nebraska law specifically holds that an employer cannot terminate an employee solely for filing a workers’ compensation claim.
