In most workers’ compensation cases, the benefits paid out to the employee are paid by a workers’ compensation insurance company. Most companies, depending on their size, are required to have workers’ compensation insurance coverage in case their employees are hurt.
When there is a workers’ compensation insurance policy in place, the insurance company, and not your employer, will be paying your benefits. There are some limited exceptions to this rule, for example when a company is self-insured or when they are in violation of the law requiring them to have insurance coverage.
